Under møtet fikk vi følgende opplysninger:
---- Mare Nostrum støtter våre forslag til møtet og de ville gjøre alt for å få enstemmighetDe opplyste også at IRM ville støtte de fleste ? av våre forslag.
De fullmakter som hittil var kommet inn var også poseiive.
----Estetiske forandringer krever som kjent enstemmighet blant de som avgir stemme.Det er naturligvis helt urimelig at en av 1550 stemmeberettigede
skal kunne velte et forslag .(Mindretallsdiktatur?) ,men dette er noe vi ikke kan gjøre noe med på kort sikt..Mare Nostrum hadde ingen konstruktive forslag til hvordan vi vi skulle takle en
situasjon hvor et overveldende flertall blir nedstemt av et lite mindretall og det kaos som da ville kunne oppstå.
Mare Nostrum henviste til at det da kanske var mulig å endre vedtektene på møtet i nov,men også dette krever ensstemmighet Utfallet er derfor i høyeste grad usikkert.
----Mare Nostrums jurist var svært overrasket da hun hørte at våre vedtekter (General Articles) var ukjente for de fleste av oss og opplyste at vedtektene skulle ha vært vedlagt
salgsdukumentene av Polaris. Hun var også overrasket over at våre representanter ikke hadde etterlyst disse ved registreringen av leiligheten.
Det skal forøvrig bli interessant å se om IRM følger hennes råd ved salg av sine leiligheter!
Vi vil nå anmode Mare Nostrum om å oversende vedtektene til alle eierne.
----Det er som kjent feil av Polaris ved beregningen av huleiebrøken for enkelte av leilighetene.Mare Nostrum opplyste under det siste årsmøtet at en slik oppretting ville kreve enstemmighet.
og at en slik enstemmighet var vanskelig å oppnå fordi de som da måtte få høyere husleie ville stemme imot.Vi påpekte at en slik konklusjon var å snu tingene på hodet og at man
naturligvis ikke kunne bruke vedtektene på en slik måte..Vi fikk ingen reaksjon der og da ,men foventer at denne saken kommer opp igjen.på møtet.
---Basert på ovenstående har vi sendt vedlagte brev til presidenten og Mare Nostrum.
Vi ser nå frem til møtet 2 april og håper på at sakene skal gå vår vei. Vi må igjen etterlyse fullmakter fra en del av dere Samtidig ønsker vi beskjed fra dem som selv vil være til stede eller har gitt fullmakt til andre slik at vi har oversikt.

Uten å stå sammen mister vi enhver mulighet til innflydelse.Vi er oppmerksomme på at de saker som nå kommer opp nå ikke er like aktuelle for alle.Dere vil imidlertid se at det det står meget igjen å rette opp og at vi ikke blir arbeidsledige selv om vi skulle få medhold..
Mindretallsdiktaturet kan gi de underligste utslag om noen ønsker å utnytte mulighetene som idag ligger der, !

EXTRA ORDINARY GENERAL MEETING 2 APRIL
“AESTETIC MODIFICATIONS”
In connection with the upcoming meeting we would respectfully point at the following:
The General Articles of association Level 1 was proposed, voted on and approved by Polaris World Estate S.L in a meeting may 2009. The General Articles cover basically two main areas;
1. The service scope provided by the community.
2. Securing Polaris all rights and 100% control over all decisions made.
In the articles it is claimed that the articles had been “drawn up by the members of the complex in exercise of their independent will”.
In May 2009 several hundred apartments and houses had been sold but as far as we are aware of none of these had been invited to the meeting. In addition we cannot see that the General Articles of association have been sent out to the owners or have been included in the documents presented at the final transfer of ownership.
The General Articles of association limit the individual owners´ rights and gives Polaris a control that probably are breaking the law in most other European countries for as long as they want to exercise that control.
We only want to point out that the present individual owners feel no respect or responsibility for the General Articles of association which have been forced upon them and have been unknown to the most of them up to now.
However, it must be admitted that Polaris has been exercising the power given to them with caution and that they have transferred their control to the representatives of the other communities without undue delay.
These representatives have still to live with hopeless General Articles of association and have to find ways to circumvent those articles in the daily management of their community as changing or modifying the General Articles are almost impossible.
At the upcoming meeting 2 April we have to realize that we most likely cannot expect to get unanimous approval of the esthetic changes suggested. In this situation we must respectfully ask you to vote in favor of those changes in order to get the guidelines respected by the owners. As earlier pointed out we fear that the situation will soon be out of control if IRM choose to vote against or abstaining from voting.
We also have to inform you that we are seriously concerned that our proposal to establish an advisory modification committee is not on the agenda and we have to question if we have any other viable alternatives. We – and Mare Nostrum – have already been approached by many owners who want to discuss minor alterations with the committee. Most of them are not happy, and probably not willing to wait until November this year to get a final approval at the GM. We consequently, ask you to reconsider this point in order to prevent that the problems we have today will be escalating further.
We look forward to having a fruitful cooperation with IRM benefitting all present and future owners at Mar Menor II.
